These Terms of Use govern your access to and use of fifty18.com (the "Site"), operated by Monarch Payment Systems LLC, doing business as Fifty18 ("Fifty18," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Purpose of the Site
The Site provides general information about Fifty18 and its payment processing support services. Nothing on the Site is an offer to provide financial, legal, tax, or accounting advice, or a commitment to provide any service. Payment processing services are provided only under a separate written agreement with the applicable processor, bank, or other provider, and are subject to their approval and terms.
2. Eligibility
The Site is intended for business users who are at least 18 years old and able to enter into binding contracts.
3. Acceptable use
You agree not to:
- Use the Site in violation of any law or regulation
- Attempt to gain unauthorized access to the Site, its servers, or related systems
- Introduce malware, or interfere with or disrupt the Site
- Scrape, copy, or harvest content or data by automated means without our written permission
- Submit false, misleading, or another person's information
- Send payment card numbers, bank account details, or government ID numbers through the Site
4. Intellectual property
The Site and its content, including text, graphics, logos, and design, are owned by Fifty18 or its licensors and are protected by intellectual property laws. You may view and print content for your own internal business use. Any other use requires our written permission. Third-party names and marks belong to their owners.
5. Submissions
If you send us information through a form or email, you represent that you have the right to share it. We use submitted information as described in our Privacy Policy.
6. No warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Rates, fees, and program details mentioned on the Site are illustrative and may vary by business, processor, and underwriting.
7. Limitation of liability
To the fullest extent permitted by law, Fifty18 and its owners, members, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless Fifty18 from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or breach of these Terms.

10. Changes and termination

11. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
12. General
If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy and Cookie Notice, are the entire agreement between you and Fifty18 regarding the Site.
